The lawsuit alleges that the ads violate Burck's right to privacy and infringe on his trademark by "using his likeness, persona, and image for commercial purposes without his written permission and by falsely suggesting that he endorses M&M candy."I thought the guy abandoned his right to privacy when he first entered Times Square in his underwear. I met him on the street once, in about 1985. It was pretty cold. He was all business; would only speak in country music lyrics, insisted on taking pictures for money - a real New Yorker, in fact. But I guess you can't hang around Times Square in your underwear and chat for free. He must be getting on though.

I can't the likeness - M&M is round and this guy has a body of a man. If he can win this case or this first round then I can perhaps sue Victoria Secrets for all the sexy photo shoots...just wishing.
Maybe you need to take a closer look at your M&M's ;-)
I met a guy who goes to the same gym as the Naked Cowboy. And yes, apparently, naked cowboy is ALWAYS at the gym.
Off-in-the-head, surely (Naked Cowboy, not the other guy) But I kind of see his point. He is out there everyday, in good weather and bad, and he's made a brand of himself.
Gotta admire that kind of dedication.
But mostly, I am now just hungry for M&Ms.
